Conform\u00e9ment \u00e0 l&rsquo;article L145-9 du code de <a href=\"https:\/\/www.europropmarket.com\/commerce\/\">commerce<\/a>, le contrat de bail commercial, sans \u00eatre express\u00e9ment renouvel\u00e9, va ainsi continuer \u00e0 produire ses effets pour une dur\u00e9e ind\u00e9termin\u00e9e. En cas de prolongation tacite, il faut souligner le fait que le locataire n&rsquo;est alors plus titulaire du droit au bail et peut ainsi \u00eatre priv\u00e9 de la possibilit\u00e9 de vendre son fonds de commerce. En cas de vente, l&rsquo;acqu\u00e9reur du fonds n\u00e9gociera avec le propri\u00e9taire le renouvellement du bail commercial ou la conclusion d&rsquo;un nouveau contrat. Par ailleurs si la dur\u00e9e du bail d\u00e9passe 12 ans le propri\u00e9taire pourra d\u00e9plafonner le loyer et le r\u00e9\u00e9valuer en fonction de la valeur locative : cela peut donc se traduire par une hausse du loyer pour le locataire. La prolongation tacite pr\u00e9sente un autre inconv\u00e9nient majeur pour le locataire, puisque le contrat peut prendre fin \u00e0 tout moment si le bailleur d\u00e9cide de donner cong\u00e9 ou de refuser une demande de renouvellement.<\/p>\n<h2>Le renouvellement \u00e0 l&rsquo;initiative du bailleur ou du locataire<\/h2>\n<p>Le renouvellement express du <a href=\"https:\/\/www.europropmarket.com\/commerce\/location\/\">bail commercial<\/a> r\u00e9pond \u00e0 des conditions diff\u00e9rentes selon qu&rsquo;il est formul\u00e9 par le bailleur ou le locataire. En cas de cong\u00e9 avec offre de renouvellement donn\u00e9 par le bailleur, l&rsquo;offre doit \u00eatre d\u00e9livr\u00e9e par voie d&rsquo;huissier et comporter un loyer chiffr\u00e9 que le locataire sera libre d&rsquo;accepter ou non. Si le nouveau bail commercial est en r\u00e8gle g\u00e9n\u00e9rale conclu dans les m\u00eames conditions que le pr\u00e9c\u00e9dent \u2013 et pour une dur\u00e9e de 9 ans \u2013 les parties peuvent d\u00e9cider conjointement d\u00e9cider de modifier le loyer et les conditions du contrat. Le locataire peut \u00e9galement adresser une demande de renouvellement au bailleur par lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception : ce dernier dispose alors d&rsquo;un d\u00e9lai de 3 mois pour r\u00e9pondre. En cas de silence du bailleur dans les d\u00e9lais impartis, la demande de renouvellement est r\u00e9put\u00e9e accept\u00e9e.
